Footsteps Of Discovery (Survival Matters) Limited Terms & Conditions
1. MAKING YOUR BOOKING
1.1 Before completing your booking form please confirm that there is availability on the activity of your choice. Then please complete the booking form and forward it with your non-refundable deposit of 25% of the total cost of the activity by cheque made Payable to: “Footsteps Of Discovery.”
1.2 If you make your booking within 4 weeks of the activity date we will require full payment with your booking.
1.3 We will then confirm your booking and send you further information relevant to the activity that you have booked. These terms and conditions, together with your booking form and any information that we have supplied to you forms your contract with Footsteps Of Discovery (Survival Matters) Ltd.
Footsteps of Discovery (Survival Matters) Ltd operates two methods of payment as follows:
2.1 Existing customer clients, early payment debtors. For existing customer clients, early payment debtors, a deposit of 25% of the total fee is required no less that two weeks before the course/activity. On completion of the course/activity an invoice will be presented and the following % penalty clause will apply: payment within 30 days nil % interest, payment between 30 & 60 days 5 % interest and payment between 60 & 90 days 10 % interest. Please note that we do not accept payment by any credit or debit card. We accept:

(2.3) Direct Bank Transfer in to an account specified by Footsteps Of Discovery (Survival Matters) Ltd
(2.4) Banker’s draft. (Bank details available on request from Footsteps of Discovery (Survival Matters) Ltd
2.5 New customer clients, late payment debtors.
2.6 New customer clients, late payment debtors, The balance of the fee as specified on the booking form must be paid in full by the date specified on the booking form, or if no date is specified, no later than four weeks before the course/activity. If not so paid Footstep’s reserves the right to treat the agreement as cancelled by the client or organisation.
2A. TERMS OF PAYMENT
New customer clients, late payment debtors, In certain cases, depending on the organisation we shall send you a final invoice 10 weeks before or as soon as the course/activity has been confirmed this will also show any surcharge due. You must pay the invoice within 30 days of the invoice date; otherwise we reserve the right to incur the % interest as mentioned above in Para 2.1
3.1 The price for the activity includes the costs of catering, non-alcoholic drinks, and all training equipment, and insurance except where stated.
4.1 Footsteps Of Discovery (Survival Matters) Ltd. Hold full indemnity insurance with Activity Industry Mutual as follows:
- Employer’s Liability:£10,000,000.
- Public Liability: £5,000,000.
- Products Liability: £5,000,000.
- Errors & Omissions: £100,000.
4.2 Full details of Activity Industry Mutual cover are available on request. Policy Number 27538G14
5. TRAVEL, ACCOMMODATION AND OTHER PROVIDERS
5.1 Footsteps of Discovery (Survival Matters) Ltd acts only as agents for the owners of accommodation and services provided, for all the carriers by air or otherwise and for road transport proprietors, and all bookings must be accepted subject to the ticket or transport conditions and regulations of the carriers or transport proprietors, and also subject to the laws of the Country in which such carriage or other facility is required.
5.2 Footsteps of Discovery (Survival Matters) Ltd cannot accept responsibility for any extra costs resulting from travel delays.
6.1 All participants or if under 18, their parents, are personally responsible for ensuring that they conform to the health regulations required by law. Please notify us at the time of booking if any participant has a medical condition, allergy or disability that may affect their involvement in the designated activity.
6.2 While we will try to cater for any requirements, we cannot guarantee that we will be able to do so for those with special needs or serious medical conditions.
7.1 Our prices are based on tariffs, exchange rates and other costs as at the date of the quotation.
7.2 We reserve the right to increase the price of activity to the extent that:
7.3 Relevant currency exchange rates alter more than 2% (as given by a high street bank).
7.4 A government or official authority levies or increases a tax, or
7.5 Transportation costs increase (in each case between the date of confirmation of your booking form and the date of departure).
7.6 In respect of any compulsory taxes which may be imposed and which are outside our control.
8. CANCELLATION BY YOU
8.1 You or any member of your party may cancel your activity at any time providing that the person who signed the booking form makes the cancellation and it is communicated in writing to Footsteps Of Discovery (Survival Matters) Ltd. (by recorded delivery post), preceded by a phone call.
8.2 The following cancellation charges will apply, the days in question being calculated from the date on which we receive your written cancellation notice by post. The total activity cost for cancellations is defined as the total invoiced amount shown on your course/activity invoice.

9. BROCHURE / WEBSITE ACCURACY
9.1 All information given in our brochures / websites / quotations are, to Footsteps Of Discovery (Survival Matters) Ltd’s knowledge, correct at the time of going to press, but services and facilities may change and whenever possible we will advise you of such changes prior to the activity commencement date.
10. ALTERATIONS TO OR CANCELLATION OF ACTIVITIES
10.1 Activities are costed on a minimum number of participating clients. Substitution of one participant for another may be possible. However, if this minimum number is not reached we will either cancel the activity or offer a refund in full, or, subject to the participant’s agreement, we will operate the activity at the necessary supplement. We may be able to make alterations to the booking at your request but we cannot guarantee this. We cannot make any alterations on the day of the activity.
10.2 We will do our utmost to provide the activity arrangements that have been confirmed, but we reserve the right to modify or cancel any, arrangement or to make alterations even after the confirmation of bookings. In such circumstances, we will inform you as soon as possible and, should the change be such, that it alters the nature of the activity, we shall give you the choice of an alternative activity or a full refund of all money paid.
11. ACCOMODATION AND MEALS
11.1 Accommodation will be as detailed in the activity brochure or quotation. This is normally in the form of a tent/poncho cover, vehicle, etc provide by the client/organisation. Meals will comprise of basic food cooked on an open fire.
11.2 Any special dietary requirements must be notified to us at the time of booking. Whilst every effort will be made to meet such requests, they cannot be guaranteed.
12.1 We shall endeavour to afford general assistance to our participants in the event of illness or injury or during the period of the activity. We accept responsibility for ensuring that all parts of an activity are supplied as described and that all services shall reach a reasonable standard.
12.2 Footsteps Of Discovery (Survival Matters) Ltd cannot accept responsibility or pay any compensation for events beyond its control, such as (without limitation) acts of God, war (whether declared or undeclared) terrorist activities, currency fluctuations, strikes or government restrictions. Except in the case of death or personal injury caused by Footsteps Of Discovery (Survival Matters) Ltd’s negligence, our liability for non-performance or improper performance of our contract with you shall be limited to refunding the full price of the activity in respect of each booking.
13. BAGGAGE & PERSONAL EFFECTS
13.1 These remain your responsibility and at your risk at all times. We advise against carrying large amounts of money or items of high value. Money and valuable items should at no time be left unattended. Footsteps Of Discovery (Survival Matters) Ltd will incur no responsibility for loss of documents or for loss of, or damage to, luggage or any other belongings of participants, unless our negligence can be proved. Please note that a survival course/activity is not the place to bring expensive watches, jewellery or other precious items, which will not be covered by Footsteps Of Discovery (Survival Matters) Ltd’s insurance.
14. CONDUCT OF PARTICIPANTS
14.1 It is the responsibility of any parent guardian or other person acting in ‘loco parentis’ to advise Footsteps Of Discovery (Survival Matters) Ltd in advance of any disabilities or any social or behavioural problems that a young person currently has, or has recently experienced, which might affect the young person or other guests during the activity.
14.2 All participants are required to observe high standards of conduct and parents of unaccompanied minors will be asked to complete an in loco parentis’ form prior to the commencement of the activity.
14.3 Footsteps Of Discovery (Survival Matters) Ltd reserves the right to not accept or send home any client, at the client’s own cost, who in the opinion of the activity leader is unsuitable for the activity.
14.4 The use of recreational drugs is prohibited on any activity organized and conducted by Footsteps Of Discovery (Survival Matters) Ltd. Participants found in possession of drugs will be reported to the police, and immediately removed from all activities and sent home at individual expense.
14.5 Footsteps Of Discovery (Survival Matters) Ltd reserve the right to terminate the participation in the activity of any person causing damage or offence and will not be obliged to cover any additional expense or to offer compensation.
15. CONSUMER PROTECTION
15.1 Footsteps Of Discovery (Survival Matters) Ltd do not offer activities where travel costs are included. Clients are responsible for making their own travel arrangements.
15.2 Clients should be aware that all monies paid in advance as deposits or final payments will be held in Footsteps of Discovery (Survival Matters) Ltd Client Trust Account. This is in accordance with The Statutory Instruments 1992 No: 3288 Consumer Protection, These payments will only be transferred from the Footsteps of Discovery (Survival Matters) Ltd Trust Account on successful completion of the activities.
16.1 We shall always endeavour to resolve any complaints on the spot, however if the matter cannot be resolved you must write to Tony Manley MBE, David Mark Sainsbury or John Mackenzie Dillon, Managing Directors, within 14 days of the end of the activity. We shall endeavour to resolve the problem as promptly as possible. In the unlikely event that the problem is not amicably resolved the case will be referred to arbitration within the Arbitration Acts 1950 to 1996 or any statutory re-enactment.
17. GOVERNING LAW
17.1 This contract shall be governed by English law and shall be subject to the non exclusive jurisdiction of the English Courts.
18. PERSONAL IDENTIFICATION INFORMATION
18.1 We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site place an order and in connection with other activities, services, features or resources we make available on our Site.
18.2 Users may be asked for, as appropriate, name, email address, mailing address, phone number, credit card information,
